These Website Terms & Conditions ("Terms") govern access to and use of the website for Asthma Allergy Care & Treatment (the "Site"), operated by Harmony Medical PLLC ("Harmony Medical," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
You may use the Site only if you are at least 18 years old or are using the Site under the supervision of a parent, legal guardian, or other authorized representative. If you use the Site on behalf of another person, you represent that you have authority to do so and to provide information to us for that person.
The Site is provided for general informational and educational purposes only. Content on the Site does not constitute medical advice, diagnosis, or treatment, and it does not replace an in-person or telehealth evaluation by a licensed clinician. Use of the Site does not by itself create a physician-patient relationship. A physician-patient relationship is formed only when Harmony Medical affirmatively accepts you as a patient and appropriate clinical and administrative requirements have been completed.
Do not use the Site, contact forms, chat features, email, or text messaging for emergencies or urgent medical needs. If you believe you have a medical emergency, call 911 immediately or go to the nearest emergency room.
The Site may allow you to request appointments, submit information, access or be redirected to a patient portal, or receive links related to telehealth or patient communications. Appointment requests are not confirmed until you receive confirmation from Harmony Medical. Access to a patient portal or telehealth platform may be subject to separate terms and privacy notices from the applicable vendor and separate consent documents from Harmony Medical.
You agree to provide current, complete, and accurate information when using the Site. You are responsible for maintaining the confidentiality of any username, password, portal credentials, or device used to access your information. You must notify us promptly if you believe your credentials or account information have been compromised.
You may use the Site only for lawful, personal, noncommercial purposes related to learning about the practice, communicating with the practice, and managing your care with us where offered. You may not:
The Site and its text, design, graphics, logos, images, audio, video, software, and other content are owned by or licensed to Harmony Medical and are protected by copyright, trademark, and other applicable laws. Except for limited personal use as permitted by these Terms, no right, title, or license is granted to you.
The Site may contain links to third-party websites, maps, scheduling systems, patient portals, telehealth tools, social media platforms, or other services. We do not control third-party services and are not responsible for their content, accuracy, availability, privacy practices, security, or terms. Accessing them is at your own risk.
The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Harmony Medical disclaims all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or uninterrupted availability. We do not guarantee that the Site will always be secure, error-free, or available.
To the fullest extent permitted by law, Harmony Medical and its owners, physicians, clinicians, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, business, goodwill, or use, arising from or relating to the Site or these Terms. To the fullest extent permitted by law, our total aggregate liability for claims arising from or relating to the Site or these Terms will not exceed the greater of (a) the amount, if any, you paid specifically for the Site-related service giving rise to the claim, or (b) one hundred U.S. dollars (US $100.00). Nothing in these Terms limits liability that cannot be limited under applicable law.
You agree to defend, indemnify, and hold harmless Harmony Medical and its owners, physicians, clinicians, employees, contractors, and agents from and against claims, liabilities, damages, judgments, awards, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your violation of these Terms, your misuse of the Site, or your violation of applicable law or another party's rights.
Your use of the Site is also subject to our Privacy Policy and Notice of Privacy Practices, Cookie Policy, SMS/Text Messaging Policy, Medical Disclaimer, and Telehealth/Virtual Care Consent, as applicable. If there is a conflict between these Terms and documents that specifically govern patient communications, privacy, or consent, the more specific document will control for that subject matter.
We may suspend, restrict, or terminate access to the Site or any feature at any time, with or without notice, if we believe doing so is necessary for security, maintenance, legal compliance, patient safety, or violation of these Terms.
We may modify the Site and these Terms at any time. Updated Terms will be posted on the Site with a new effective date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules, and by applicable federal law. Any dispute arising from or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in New York County, New York, and you consent to that jurisdiction and venue.
